Description:

State aid experts from EU and Member States’ authorities, private legal practice and academia will elaborate on two key-topics, the role of the MEIP and infrastructure funding, offering their insights and a maximum of exchange and best practices through an interactive round-table discussion format. The morning session is devoted to the Market Economy Investor Principle (MEIP), a private investor test which indicates whether a public company has been granted an advantage according to Art. 107 TFEU by comparing the behaviour of the State to a private investor. Another key aspect are the interfaces of the MEIP relating to public procurement leading to the question whether the mere compliance with public procurement rules guarantees that the requirements of the MEIP are met. The afternoon session will focus on the crucial question of what exactly public authorities are still allowed to finance, including recent judgments and their implications for national and EU funding. Additionally, the economic activity and the economic character of the construction of infrastructure will be addressed, considering crucial fields of compliance such as the General Block Exemption Regulation (GBER) & Services of General Economic Interest (SGEI).
